TERMS OF SERVICE

The owner of the online store www.overtheankle.comis OVER THE ANKLE OÜ (registry code 16122751), located at Pargi 1, Laatre, Valga vald 68314, Estonia.

The terms and conditions of sale apply to the rights and obligations arising from the purchase of goods by the customers of the overtheankle.com online store (hereinafter the customer/purchaser/buyer) from OVER THE ANKLE OÜ  (hereinafter online store owner/seller).

 

When registering as a user of overtheankle.com and/or purchasing products from an online store, the terms and conditions of this contract and the rights and obligations arising from the laws of the Republic of Estonia apply.

 

OVER THE ANKLE OÜ reserves the right to make changes in the terms and conditions of sale and the selling prices. The newest changes will be displayed on it’s official webpage:www.overtheankle.com

 

     1. Instructions for placing the order

For placing the order, the customer needs to click on a product he/she wants to purchase and add it to the shopping cart. In case there are more desired products it is needed to press the „continue shopping“ button and choose products from online stores sortiment. Once all products have been chosen  by the purchaser, it’s important to review order and change quantities if needed. If the order is reviewed, the purchaser has to check on „I agree with the terms and conditions“ box and can move to the „check out“ button to confirm it. On the information page all required fields need to be filled with correct  information and on the shipping page it is important to choose the right parcel terminal. The purchaser verifies that the entered data of the order is correct.

In case the purchaser has a bonus code it goes to the „bonus code“ field to get a discount from the price of the order. The discount code works only on products and will not affect the shipping fees. Total cost will be displayed and purchaser can pay it :

  1. With a credit card on the same page
  2. Via bank so purchaser will be redirected to the online payment service’s website in order to pay for order 

Purchaser needs to follow the instructions and pay for the order paying via bank link. It is important to complete the payment by clicking the „back to merchant“ button on the bank’s page.  Purchaser will receive an order confirmation email after the purchase has been completed. The invoice will be sent by email with ordered goods on it.

Online store accepts following payments:

  1. Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Liisi ID
  2. Visa / MasterCard credit card payments

 

     2. Prices and payment

Online store accepts payments with credit cards and bank links through Maksekeskus AS. All prices are in euros and displayed next to the product. Overtheankle.com reserves the right to adjust the prices. If the customer placed an order before the price adjustment took effect, they will receive the product with the price reflected in the order at the moment the order is placed. The customer is not entitled to claim compensation for the difference in price

Payments are mediated by Maksekeskus AS. Payment takes place outside the online store in a secure environment - when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card details. The agreement enters into force upon receipt of the amount due to the current account of the online store.

The owner of the online store is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. delivery costs) will be refunded within a week after the notification.

 

     3. Delivering goods

 After the contract of sale has entered into force (the customer has paid for the order), overtheankle.com will complete the order and hand it over to their logistics partner: Omniva parcel terminal. The delivery times indicated on the overtheankle.com website apply from the moment the order is paid for.

 

OVER THE ANKLE OÜ goods are shipped by Omniva courrier. The accuracy of the contact information presented in the order determines whether delays and misunderstandings arise in the delivery of goods.

 

Overtheankle.com is not responsible for the delays and misunderstandings arising in the delivery of goods if they are caused as a result of the customer presenting inaccurate contact information in the order.

 

The purchaser will receive an SMS-notification sent to a number indicated by the purchaser including a unique code providing access to the goods in the parcel terminal. The online store owner is not liable for the damages caused to the customer, for reasons not attributable to the online store owner, created by third parties as a result of acquiring the unique code of the parcel terminal and having access to the goods.

 

All shipments within Estonia generally arrive at the destination specified by the purchaser within 2-3 business days of the date of entry into force of the contract of sale. Owner of the online store has the right to ship goods in up to 45 calendar days in exceptional cases.

 

     4. Right of withdrawal

The customer may withdraw from the contract within 14 days after receiving the goods. The right of withdrawal does not apply if the purchaser is a legal person. Returned goods must be unwashed, unworn and in original package with all details. The customer must bear the cost of returning, unless the reason for returning is non-compliance with the order or defective goods. To return the goods, the customer needs to contact via email address info@overtheankle.com within 14 days after receiving the goods. The statement of withdrawal must include the name of the customer, the name of the product, date and the number of the invoice or the order.

The customer will be reimbursed within a week after receiving the statement of withdrawal. In addition to that, the cost of delivery will also be reimbursed to the customer (if the reason for return is defective or wrong item). The online store has the right to withdraw from the sale transaction and demand the goods back from the buyer if the price of the goods in the online store is significantly below the market price of the goods due to a mistake.

 

 

     5. Claims procedure

Customer is entitled to make claims against the seller in case any lack of conformity of a product becomes apparent within two years as of the date of delivery of the product. It is presumed that any defect that becomes apparent within the first six months existed at the moment of the sale and, therefore, the nature of the defect is to be identified by the seller.

 

If a product defect occurs, the customer must inform seller by sending  an email to info@overtheankle.com including the following: their name, contact information, order number and a photo of defect. The statement must be sent no later than two months after discovering the defect.

The online store is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing and which became apparent within two years from the delivery of the goods to the buyer.

 

The online store owner is not liable for any damages caused to the customer or delay in the delivery of the product if the delay in delivery of the product is caused by a fact that could not be influenced by the online store owner and which the online store owner did not anticipate and could not see.

 

The online store is not liable for any defects arising after delivering the goods to the purchaser and damages caused by abnormal use of goods. If goods bought from the online store have defects for which the online store is responsible, the online store will replace the defective goods. If the goods can not be replaced, then the online store returns all payments involved in the contract of sale. The online store responds to the customer’s complaints in written form within 15 days.

 

     6. Direct marketing and personal data processing

The online store uses the personal data entered by the purchaser (including name, phone number, address, e-mail and bank details) for processing the order and sending goods to purchaser. The online store sends data to the transport service provider to deliver the goods. The seller processes the buyer’s personal data in conformity with the privacy policy which is available at https://overtheankle.com/pages/privacy-policy-

The online store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has accepted that by entering their email on the website and indicating their request to receive direct mail. The purchaser is able to cancel  permission to send offers and newsletters to their email by letting online store know by email.

 

     7. Settlements of disputes

All complaints made by purchaser about online store and products must be emailed in English or Estonian language to info@overtheankle.com or overtheankle@gmail.com

In case the buyer and online store owner can not solve the problems then Consumer Dispute Committee is competent to resolve disputes arising from contract between two sides.


The online store owner presumes that the customer has understood and accepted the current „Terms of Service“ and „Privacy Policy“ before placing an order or making a purchase.
